Who these terms are for
These terms cover the use of the website www.daylings.app and its waiting list. They are an agreement between whoever uses them and Mesquita Gouveia, Lda., a Portuguese company with its registered address at Travessa do Salvador, 213, 4495-592 Terroso, Portugal and company tax number (NIPC) 516486870. We can be reached at hello@daylings.app.
They do not cover the Daylings themselves or the parent app, and nothing is for sale yet. When ordering opens, Daylings and the app will have their own terms and privacy information, and they will be shown before anyone buys or signs in.
The site and the waiting list are for adults, aged 18 or over.
Using the site
Anyone is welcome to read the site and share its address. Please do not:
- break the law with it, or use it to harm anyone;
- try to disrupt it, overload it or get into parts of it that are not meant to be open;
- send the waiting list form addresses that are not the sender’s own, or send it automatically.
The waiting list
- Joining is free. It is not an order, a reservation or a promise to sell anyone anything.
- We use the address to confirm the entry and to send one email when a Dayling can be ordered. Nothing else. The privacy policy explains the details, including how long we keep it.
- Anyone can leave at any time with the link in any of our emails.
- We may remove an entry we think is abusive or automated.
What the site says
We try to keep the site accurate and honest. But the product is still being finished, so descriptions, features, dates and prices on the site are plans, not an offer to sell. They can change before ordering opens, and we will state what applies at the time of the order.
Our work
The texts, drawings, creatures, the Daylings name and mark, and the design of the site belong to Mesquita Gouveia, Lda. or are used with permission. A link to the site can be shared, and short parts of it quoted with credit. Please ask first before copying more or using the name and drawings for something of one’s own.
Links
The site may link to other websites. We do not control them and are not responsible for what they say or do.
Our responsibility
The site is provided as it is, free of charge. We do our best to keep it running, but we do not promise it will always be available or free of errors, and we may change or take it down.
We are not responsible for losses that come from using the site or the waiting list, except where the law does not let us exclude it. In particular, nothing in these terms limits our responsibility for intent or serious fault, for harm to life, body or health, or any right a consumer has that cannot be waived.
Changes
We may update these terms. The date at the top shows the latest version. If a change matters to people on the waiting list, we will tell them.
Law and complaints
Portuguese law applies to these terms. A consumer also keeps the protections that the mandatory law of the country where they live gives them, and may bring a claim in the courts of that country.
If something is wrong, write to hello@daylings.app and we will answer as soon as we can. For personal data matters, see the privacy policy. When ordering opens, we will also give the information consumers are entitled to about complaints and out-of-court dispute resolution.
